Retained Search vs Contingent Recruitment for US AI Startups

If you are hiring your first AI engineering lead or enterprise seller, the recruitment fee is only one part of the decision. You are choosing how much attention the search receives, who owns the work and how the recruiter behaves when the obvious candidates say no.

For Seed–Series B AI startups in the US, retained search and contingent recruitment can both work. The right choice depends on the role, the available candidate market and how ready the company is to hire. Paying upfront does not guarantee quality. Paying only on success does not remove the cost of an unsuccessful search.

What is the difference?

Retained search involves an agreed payment to begin work, often followed by milestone or completion payments. It is commonly exclusive. Contingent recruitment typically means a fee becomes payable following a successful placement, under the contract’s defined trigger. It can be exclusive or involve multiple agencies.

Do not confuse exclusivity with retention. An exclusive contingent arrangement can give one recruiter a clear mandate without an initial payment. Equally, an engagement fee may be credited against the final placement fee rather than added to it. Read the actual terms.

Question Retained search Contingent recruitment
When do you commit cash? At engagement and agreed stages Usually when a placement triggers the fee
What should you expect? A defined research, outreach and assessment assignment Candidate sourcing and introductions against an agreed brief
Where can it fit? Critical, confidential or difficult-to-map hires Well-defined hires with a reachable candidate pool
Main risk to manage Paying for activity without useful delivery The search losing priority or becoming a race to introduce CVs

The AESC Client Bill of Rights describes retained executive search as an exclusive advisory relationship and calls for written clarity on scope, timing, fees, deliverables and conflicts. Those are useful questions for any founder, although its standards specifically describe AESC member firms.

Choose around the consequence of getting it wrong

A first technical leader who will define your architecture is different from a clearly scoped individual contributor joining an established team. A founding AE who must prove a sales motion is different from another seller entering a functioning territory.

Retained search becomes easier to justify when the hire is business-critical, the candidate pool is narrow or the work needs substantial investigation. That might mean mapping applied AI engineers with production ownership in San Francisco, or finding a New York commercial leader who has sold into banks without relying on a famous employer’s brand.

For a familiar profile, a realistic package and a hiring manager ready to move, contingent recruitment can be entirely appropriate. The question is whether the recruiter can deliver the specific search, not whether one commercial model sounds more premium.

US geography changes the brief

A five-day onsite San Francisco search and a remote US search are different assignments. In New York, buyer experience in financial services may matter more than an AI job title. A nationwide search still needs clarity on eligible states, time-zone overlap and how compensation will be set.

Before choosing a model, agree the office address, attendance requirement, work-authorisation approach, salary range, equity story and interview process. Our guide to San Francisco versus New York for a US GTM team explains why location should follow the customer and talent strategy.

A retainer cannot make an unrealistic package competitive. A contingent recruiter cannot turn a vague “AI superstar” brief into a repeatable assessment unless someone does the work to define success.

Compare total fees, not the initial invoice

Here is a deliberately simple illustration, not a market benchmark or Dataworks quote. At a $200,000 base salary, a 20% placement fee totals $40,000. If a retained agreement charges $8,000 upfront credited against that fee, the remaining balance would be $32,000. If the engagement payment is additional, the total would instead be $48,000.

Ask whether the percentage applies to base salary or wider compensation. Confirm expenses, taxes where applicable, payment dates, cancellation terms and replacement provisions. A replacement commitment is not necessarily a cash refund.

Also model the cost of delay using your own business assumptions: founder time, product milestones and customer commitments. Avoid attaching an invented revenue figure to every vacant seat. The value of faster hiring depends on what that person can actually change.

Make the delivery commitment visible

Before signing a retained agreement, ask what the initial payment buys. There should be a named delivery owner, target-market logic, assessment criteria, regular reporting and a clear response when the market rejects the brief.

For contingent recruitment, ask the same operational questions. How much capacity is available? Will you see passive candidates? How are duplicate introductions handled? What happens if another agency approaches the same people?

Measure useful progress: relevant conversations, reasons candidates decline, shortlist quality and interview conversion. A long spreadsheet is not evidence that the right market has been covered. Nor should a recruiter promise an exact hiring date before testing the role.

Keep assessment consistent whichever model you choose

A recruiter should help you evaluate what candidates personally delivered. For technical roles, test production judgement and ownership. For GTM roles, examine buyer fit, pipeline source, deal complexity and the support behind previous results. Our founding AE versus VP Sales guide is useful if the role itself is still unresolved.

Keep selection criteria relevant to the job and apply them consistently. The EEOC’s small-business resources explain federal employment-discrimination responsibilities and hiring considerations; state and local requirements also need attention. Outsourcing recruitment does not replace the founder’s responsibility to run a sound process.
